1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern your access to and use of crashcomp.com (the “Site”) and the attorney referral and matching service operated by CrashComp Legal Referral Services (“CrashComp,” “we,” “us,” or “our”). By accessing the Site or submitting information through it, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Service.
2. Nature of the Service — Attorney Referral Only
CrashComp operates an attorney referral and matching service. We are not a law firm, do not employ attorneys to represent users, and do not otherwise practice law. Our Service is limited to attempting to connect individuals who submit information through the Site with an independent, licensed attorney or law firm in our network.
No attorney-client relationship is created by your use of the Site, submission of the matching form, or any communication with CrashComp. An attorney-client relationship, if any, is formed only directly between you and an attorney or law firm you choose to retain, under terms that attorney or firm provides separately.
3. No Legal Advice
Nothing on the Site, including blog articles, guides, FAQs, or any other content, constitutes legal advice. Content on the Site is provided for general informational purposes only and should not be relied upon as a substitute for consultation with a licensed attorney regarding your specific circumstances. Laws vary by state and change over time; you should not act or refrain from acting based on Site content without seeking individualized legal advice.
4. No Guarantee of Matching, Outcome, or Results
We attempt to match users with an attorney based on the information submitted, but we do not guarantee:
- That any attorney match will be made, or made within any particular timeframe;
- That any attorney will accept your case;
- Any particular legal outcome, settlement amount, or degree of success in any matter; or
- The quality, competence, availability, or conduct of any attorney or law firm in our network.
Past results referenced anywhere on the Site, including any testimonials, are not predictive of future outcomes and do not guarantee a similar result in any other matter.
5. No Responsibility for Attorneys or Law Firms
Attorneys and law firms in our network are independent third parties and are not our employees, agents, joint venturers, or partners. CrashComp is not responsible or liable for the actions, advice, services, negligence, malpractice, billing practices, communications, fee arrangements, or outcomes of any attorney or law firm you are matched with or otherwise retain. Any dispute regarding legal representation, fees, or case handling is solely between you and the applicable attorney or law firm.
6. Your Responsibility to Select and Vet an Attorney
You remain solely responsible for evaluating, selecting, and deciding whether to retain any attorney or law firm, including verifying that attorney's licensing, experience, and suitability for your matter. We encourage you to ask questions during any consultation and to make an independent, informed decision before entering into any representation agreement.
7. Eligibility, Location, and Consent to Contact
By submitting the matching form, you represent and confirm that:
- You are at least 18 years old and legally capable of entering into these Terms;
- You are located within the United States; and
- You consent to receive telephone calls and text messages, including calls made using an automatic telephone dialing system or artificial or prerecorded voice where legally permitted, from CrashComp and/or a matched attorney or law firm regarding attorney matching services, at the phone number you provide, even if that number is registered on a state or federal Do-Not-Call list.
Consent to receive such calls or texts is not a condition of using our Service. Standard message and data rates may apply. You may revoke consent at any time by contacting us as described in our Privacy Policy.
8. How We Share Your Submitted Information
Information you submit through our matching form is shared only with the single attorney or law firm selected as your match, for the purpose of facilitating that referral. We do not sell your personal information or otherwise transfer it to unrelated third parties, except as necessary to operate the Service (such as hosting or telephony providers bound by confidentiality obligations) or as required by law, subpoena, court order, or to protect the rights, safety, or property of CrashComp or others. 9. Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent information through the Site;
- Use the Site or Service for any unlawful purpose or in violation of these Terms;
- Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its systems;
- Scrape, harvest, or use automated means to extract data from the Site without our written permission; or
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
10. Intellectual Property
All content on the Site, including text, graphics, logos, the CrashComp name and brand mark, icons, and the design and compilation of the Site, is the property of CrashComp or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except as necessary to use the Site for its intended personal, non-commercial purpose, you may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written consent.
11. Disclaimer of Warranties
The site and service are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of content. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any defects will be corrected.
12. Limitation of Liability
To the fullest extent permitted by law, CrashComp and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site or service, any attorney match, or any attorney or law firm's conduct, even if advised of the possibility of such damages. To the extent any liability is not excluded, our total aggregate liability arising out of or relating to these terms or the service shall not exceed one hundred dollars ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless CrashComp and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site or Service, your violation of these Terms, or your violation of any rights of a third party.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles, except where preempted by applicable federal law.
Any dispute arising out of or relating to these Terms, the Site, or the Service shall first be attempted to be resolved through good-faith informal negotiation. If a dispute cannot be resolved informally, both parties agree that it shall be resolved through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court where eligible. You and CrashComp each waive any right to a jury trial or to participate in a class action to the fullest extent permitted by law.
15. Changes to the Site, Service, or Terms
We may modify, suspend, or discontinue the Site or Service, in whole or in part, at any time without liability. We may also update these Terms from time to time; the revised version will be posted with an updated “Last updated” date, and your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
16. Severability and Waiver
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
17. Entire Agreement
These Terms, together with our Privacy Policy, Disclaimer, and Cookie Policy, constitute the entire agreement between you and CrashComp regarding the Site and Service and supersede any prior agreements or understandings.
